Hmm, What Can I Secede For and Have History Judge me Positively?

The Volokh Conspiracy is talking about secession and stupidity, and making some … interesting … arguments about secession being a viable option.

I agree that the constitutional/legal issue of secession has not been dealt with.  That being said, it is well nigh impossible to imagine circumstances in which the U.S. Government would allow a peaceable secession.  But the point that really interests me is this:

Choice of Law

I’m uncomfortable with mandatory binding arbitration as well as choice of law statutes, but this just takes the cake.  Blackwater is trying to get a wrongful death claim tried under Sharia law, and I’m sure this is just a coincidence:
If the judge agrees, it would essentially end the lawsuit over a botched flight supporting the U.S. military. Shari’a law does not hold a company responsible for the actions of employees performed within the course of their work.

Apparently, we’ve done away with those pesky rules of evidence

According to Ted Frank, something that happened in 1982 is proof, proof I say, that the exact same thing is happening now.  Even though no evidence exists to that effect.  Link.

I’m glad that Federal Rule of Evidence 404 and 405 are no longer applicable, those pesky buggers always got in the way.
